AUGUSTA  — A Maine man charged with killing an Augusta man whose body was found during the weekend is due to make his first court appearance.

Thirty-year-old Peter Bathgate of Augusta is to appear in Kennebec County Superior Court this morning.

Bathgate was arrested after refusing to leave an Augusta apartment when state and local police arrived early Tuesday to arrest him. He surrendered at after a state police tactical squad fired tear gas into the apartment to end a 10-hour standoff.

Bathgate is charged in the death of 47-year-old Paul Allen of Augusta, whose body was found on Sunday alongside a road on the outskirts of Hallowell.

Maine Public Safety Department spokesman Steve McCausland says Bathgate was charged with murder. The cause of death has not been released.
