SOUTH PORTLAND — South Portland police say they’ve charged a 37-year-old man after seizing 135 pot plants and more than 2 pounds of processed marijuana from his home on Harborview Avenue.

Brendan McGann is charged with felony cultivation of marijuana and marijuana trafficking.

Police say McGann last fall reported the theft of four marijuana plants from his backyard. At the time, he told police he was allowed to grow the plants because he was registered as a “caregiver” under state medical marijuana laws.

Upon further investigation, police say they determined McGann was not registered with the state and therefore couldn’t legally grow marijuana. Maine’s medical marijuana law allows registered caregivers to grow up to six marijuana plants for up to five medical marijuana patients.
