PORTLAND — A Windham man who fatally shot another man who was among his marijuana plants last year was sentenced to 10 years in prison today.

Joseph Green, 45, pleaded guilty to manslaughter in Cumberland County Superior Court this afternoon in connection with the death of 40-year-old David Harmon. Green also pleaded guilty to reckless conduct with a dangerous weapon, possession of a firearm by a prohibited person and aggravated cultivation of marijuana.

Justice Roland Cole sentenced Green to 17 years in prison, with all but 10 years suspended, on the manslaughter charge. Green received five years for each of the other three charges. The sentences will run concurrently.

Harmon’s family members told the court that Harmon planned to steal pot plants because he was desperate to save his home from foreclosure. According to the prosecution, Green had shot at someone else who had tried to take marijuana plants from his property the day before firing on Harmon.
