FairPoint Communications and one of its labor unions attended a hearing on Wednesday over the company’s use of an out-of-state contractor to perform union work.

The hearing was before the U.S. Court of Appeals for the First Circuit in Boston.

The issue centered on a March, 2012 decision by an arbitrator, who ruled that FairPoint violated a collective bargaining agreement with the union by hiring an out-of-state contractor.

FairPoint filed a motion with the U.S. District Court of Maine, seeking to vacate that decision. In January, the court said the company failed to present grounds to vacate the arbitrator’s decision. The company then filed an appeal.

The union and FairPoint did not immediately return calls seeking comment about Wednesday’s hearing.

FairPoint said in April it would cut about 90 positions across Maine, New Hampshire and Vermont. The company has about 3,300 employees across 17 states.
