HAMPTON, N.H. — A New Hampshire judge has rejected key blood-test evidence in the case against a Hampton woman facing trial on charges of driving drunk and killing a pedestrian.
Judge David Anderson of the Rockingham Superior Court ruled that Hampton Police should have obtained a search warrant before taking key blood samples from Denise Kooyoomjian after her arrest in October of 2013.
The judge rejected a prosecutor’s argument that by the time police could get a warrant, the defendant’s blood-alcohol content would have declined. He ruled that police could have prepared a warrant application more quickly than they did.
Police say Kooyoomjian, who’s scheduled for trial on Monday, struck and killed 57-year-old Charles Sayre of Amesbury, Mass.
