A Windham police officer was sexually harassed by a fellow officer and then retaliated against by other members of the department for reporting the harassment, the Maine Human Rights Commission decided Monday.

Danielle Cyr, who returned to the Windham Police Department last week, had been on leave since January 2010, a few months after an officer was fired following an investigation into Cyr’s complaints about him.

A Feb. 9 report by commission investigator Angela Tizon concluded that the town of Windham had discriminated against Cyr, but had not retaliated against her, because her pay wasn’t decreased, she wasn’t denied promotions and she didn’t receive poor performance reviews after reporting harassment.

The commission, however, decided behavior by other members of the department, who Cyr said shunned her, constituted retaliation.

According to the report, Cyr first complained to supervisors of her co-worker’s unwanted touching in March 2009. She later reported that he urinated in front of her, yelled at her and demeaned her while responding to calls.

An investigation also found that “foul language, conversations which included sexual connotations and innuendo, bag tagging (slapping another’s scrotum) and good gaming (slapping another’s rear end) were the norm for the entire department,” the report said.

Windham Town Manager Tony Plante said the department has since strengthened policies, procedures and training around sexual harassment.

Representatives for Cyr and the town will participate in a conciliation process to settle the case.

Cyr’s attorney, Rebecca Webber, said she was not sure yet what compensation her client might be seeking and that those negotiations would be confidential. She said Cyr, who was not available for comment, was paid worker’s compensation during her leave.

Cyr began work part-time on Feb. 27, is receiving field training and should be working full-time within a couple of weeks, said Plante. She was originally hired by the department in 2006.

Plante said he was disappointed in the commission’s decision regarding retaliation.

“I’m glad to have her back,” he said. “I hope we can put this whole episode behind us.”
