SKOWHEGAN — The lawyer for a 10-year-old girl charged with manslaughter in the death of an infant said Friday that no court paperwork has been filed in the case and said his client is not being held at a juvenile detention facility.

Brooklyn Foss-Greenaway of Clinton died on July 8 while being baby-sat overnight at a home in Fairfield.

The 10-year-old girl was charged with manslaughter on Thursday in the death of the 3-month-old baby last month.

John Martin, who represents the girl, was issued a court summons ordering the girl to appear in Skowhegan District Court on Oct. 22. Martin said he does not anticipate discussing the case in detail because of his client’s age.

“Given the nature of the case, I may remain quite close-lipped,” Martin said.

Prosecutors say once the paperwork formally charging the girl is submitted to the court, more details about the crime will be available.

Authorities continue to withhold the girl’s identity because of her age, though once the juvenile petition is filed, her identity will be made public.

Deputy Attorney General William Stokes said Friday morning the 10-year-old Fairfield girl is in the custody of the Department of Health and Human Services but not in relation to the criminal charges against her.

Stokes said the girl was issued a summons to appear in court but has not been detained by police. That means the state does not have to submit its formal charges to the court as quickly, since there is no issue of having her released from custody pending trial.

The Department of Health and Human Services has declined to discuss the case on the advice of the Attorney General’s Office.
