New twists on the false filing about abduction

The parents of a 3-year-old now say they combined several encounters into a single event.

OLD ORCHARD BEACH - The couple who told police that a Saco man tried to grab their 3-year-old son maintain that the incident happened, but not on the day they reported it.

Meanwhile, Eric Auger says he spent three weeks in jail based on a false report that prompted death threats against him and terrified his mother, with whom he lives.

"One day would have been too long," he said Tuesday of his stay in the York County Jail. "They were calling me a child rapist, every name in the book, telling me to kill myself.

"I think those people should be thrown in jail for three weeks at least, maybe more," he said of his accusers.

Police announced Monday that the charge against Auger has been dismissed, and that they are considering charging the couple with filing a false report.

Shelly Prescott said that police statement and the dismissal of the charge make her look like a liar. "He did grab the child. We're not liars. There's plenty of witnesses," she said Tuesday.

She said that when she and her husband gave their statement to officers on June 22, they consolidated their encounters with Auger over a few days into a single incident report. The officers encouraged them to do that to make the charge stick, she said.

Auger did grab her son in front of the Pine Grove Cabins and start walking away before her husband chased him off, she said -- "a day or two" before they made their report.

In a second incident, she said, Auger took her son's hand and started walking away.

Prescott said she and her husband, Clyde, agreed to drop the charge because they were told that Auger could get treatment.

They were staying in the Pine Grove Cabins while they renovated their home in Saco, said Prescott, who grew up in Maine but lived recently in Texas.

York County District Attorney Mark Lawrence said he decided, in consultation with investigators in Old Orchard Beach, to clear Auger of the charge of criminal restraint, a felony that could lead to prison time.

It was dismissed without prejudice, meaning it could be brought again if there is new information. Lawrence would not elaborate on the dismissal, citing the ongoing investigation.

Deputy Police Chief Keith Babin said his officers were right in arresting Auger, and followed up with thorough police work that led to the dismissal.

"I don't think we jumped the gun at all" in arresting Auger, he said. "With the information we had, we had the probable cause (to make an arrest) and the officers acted appropriately."

Babin said a witness who had not been interviewed came forward after Auger's arrest, and the follow-up interviews led to the new conclusion.

Babin could not be reached late Tuesday to say whether investigators encouraged Prescott to consolidate the incidents into a single report. Prescott said she has retained a lawyer.

Auger's lawyer said he is exploring a civil case but has not determined who would be the target of a lawsuit.

"He has maintained his innocence from the beginning," said Bernard Broder. "If the police had not continued to investigate and uncover additional and differing witness accounts, then we wouldn't be where we are today."

The incident has had a profound impact on Auger, he said.

"Once you've had media divulge your street address or show footage of it, it's very hard to get your life back," he said, "not only for the defendant but their family."

After Auger's arraignment on June 23, police said he had tried to snatch a 3-year-old boy and was carrying him away when the father intervened. Police arrested Auger later because he matched the description given by the parents. Auger denied trying to take the child and said he didn't know why the man had confronted him.

Auger has a history of making people uncomfortable. He is 6 feet tall and almost 200 pounds, and suffers from a bipolar disorder that leads him to shout obscenities and argue with himself, sometimes loudly.

The operator of a day care center near Auger's home, on Norman Street in Saco, got a protection-from-harassment order against him last fall after he repeatedly rode his bicycle past the front yard where the children play, spitting and swearing. He also stood for extended periods on the sidewalk, watching the children.

Auger's mother told police that her son does not take his medicine, according to a police statement that accompanies the protection order.

However disquieting, the behavior is seldom illegal, said Saco Police Chief Brad Paul.

"From a police perspective, it's difficult to address because there's no clear violation of law," he said of many of the complaints about Auger.

Police have told Auger to stay away from a half-dozen places in town, the police chief said.

Authorities can involuntarily commit someone only if they pose an imminent threat of harm to themselves or others. "That's clearly not the case with Eric Auger," Paul said.

Dawn Major, who is staying at the Pine Grove Cabins, said she has lived in the area for years and has had many run-ins with Auger. "The guy is scary, but I've never known him to grab anyone," she said. "He is getting scarier and scarier."

Major warned Prescott and her husband about Auger, saying they should keep an eye on their son. She said Auger would stand on the sidewalk near where the boy played in front of Prescott's cabin, and watch him.

Prescott said she has heard many stories about Auger and is convinced that he should not have been released.

"This had been going on for two weeks; he had been watching our son," she said. "It's not against the law to protect your children."

If you can't afford an attorney you will be dragged through the garbage and thrown out the other end. Could someone tell me what would happen if Auger had enough money to hire an attorney as soon as he was taken into custody ?

I hope that he sues the he.. out of the OOB Police Department and his accusers. If the cops told the accusers to lie, they should be terminated and lose their pensions. Still, this does not excuse the false report.

It sounds unlikely that anyone with Bipolar disorder would have calmly taken a child like the accusers stated. The described behavior of this guy would have terrified the child and the parents would have been alerted. It sounds more plausible that Auger's behavior annoyed people at the camp and the father saw this as a way to solve the issue. The prime thing here is that community support for the mentally ill is lacking. It's hard for an elderly parent to try to get an adult child to take meds or stay under control when that child has issues. Trained people can help if they regularly monitor the case. That's what is lacking.

Mr. Auger, if your out there reading this story, get on your med's and stay on them. This is a witch hunt to get you out of the neighborhood. Stay off the booze. Because if you don't care enough for your self, they will get you committed. These people are running off rumors and here say and that is as scary as they claim you are. In the mean time go through the legal system with your lawyer and pay attention. I wish you well and you have plenty of people out here in your corner.

His mother said he doesn't take his meds, and he's not been enough of a threat to have intervention. However, child abduction would be a threat. Maybe the police did want them to lie, so he can be forcibly "treated".

Why would anyone bother watching reality TV when we have entertainment like this? Big surprise it happened in Old Orchard Beach. I have no idea why you would wait for a day (or two) or even 5 minutes to report an attempted abduction of a child. Apparently parenting needs to be licensed to keep morons from having children. I'm guessing there is probably some truth in here somewhere but our society is waaaaay too tolerant of lying. (FOX NEWS) Oops, sorry, that was Freudian as they say.

Like most problems, this was the result of several factors: lack of funding for proper treatment of the mentally ill; lack of supervision of the child; lack of urgency to report the first crime immediately; lack of honesty by the police. The question is whether any of these problems be remedied now. Frankly, I doubt they will be, so the problem will recur.

SamWalton,--Are you thinking of the child rapist who spends 15 years in prison and then when they get out rapes again or murders a child ? Has Mr. Auger ever committed such an act ? His track record of what ? What shall we the public do because we are not comfortable around the mentally ill,,,turn them into criminals so we can lock them up ! He just spent 3 weeks of his life in jail, think he got help while in there. No, we just warehouse them. These people who make false claims have the same potential of harm against society as a Mr. Auger. You may find that hard to believe, but just ask Mr. Auger who just spent 3 weeks of his life in jail for something he did not do..

How is it the parents don't remember when their son was grabbed? "A day or two" ago doesn't sound like too solid of a story. While this guy maybe not be someone anyone would want around their kids, they should have asked the police make their presence known, but not filed what still seems to be a false claim. I would not have continued staying at the cabins if I felt threatened.

Why can't people stick to the facts. Auger might have been trouble for some people, but nothing reported says he's been accused or charge of any child endangering until these people allege the abduction. I'm not defending Auger, but do you folks understand how the law works at all? Maybe someone accuses you of a heinous crime that's completely fabricated, then what? Their story is so full of holes it's silly. They should be charged, sadly their child has no chance of a quality life while growing up in this situation.

Those who falsely imprison people, even unknowingly, should be forced to repay that person's salary for that amount of time. (If no salary history, the average salary for that particular location where the person was living.) TOO OFTEN district attorneys and others get off SCOT-FREE from making false claims. You wouldn't like it if it happened to you - and based on the very frequent news stories, the chances of it happening to you are definitely not zero...

Why is the PPH continuing to have a large color picture of this man, and NONE of the parents? Their story is suspect at best – he has been released and the charges have been dropped. I think it’s irresponsible of this newspaper to seek out stories from people (without questioning their motives), and print solely negative opinions on someone WHO IS NOT BEING CHARGED WITH ANY CRIME. What’s next – pick random residents, interview whomever comes out of the woodwork to see their name in print, and run whatever negative stuff they might say?

More wrongs than rights in this mess. Its amazing that so many people used poor judgement. From the parents, to the camp owners, and to the suspect. I too was critical of law enforcement, but after this version, if true, how can you blame them. The only innocent victim was the child. And you wonder why this child would keep returning to this man, after the parents knew about the first run in? Creepy with poor judgement across the board. The accused should not be there, the parents and child should have avoided him at all costs, and the camp operators should have had him restrained from the first episode. Doesn't sound like a safe environment, unless the embellishments far outway the truth. I can't see how the cops can do anything other than what they did here, but three weeks does seem extreme. All of them need some help and have better skills to make better proventive decisions.

Having a medical condition (bipolar disorder) is not grounds for being thrown in jail. Being disliked by people in the neighborhood is not grounds for being thrown in jail. Having a strange personality is not grounds for being accused of things you didn't do. This man needs help, and instead people are demanding that he be incarcerated and that physical harm should happen to him. Shameful, un-American, and profoundly un-Christian.

Mr Auger also needs to take his meds and if he won't than his mother should contact the necessary authorites to commit him; otherwise, he will be walking the streets of PORTLAND soon enough.

Fattubbo: you have a hard time believing the cops told the accusers to lie. This same thing happened to my brother a while back....someone made a complaint against him for a misdemeanor, and had to make a decision whether to press charges or let it slide. The cops then told the accuser that my brother had been charged 3 times prior with the same charge, even though he had never been even given a speeding ticket in his life. They did this thinking that if the accuser thought my brother was a repeat offender, they would be more likely to press charges, and they did, causing a world of pain for my brother. Police lie all the time, I don't know why thats so unbelievable. I've seen it happen blatantly twice in my own personal experience.

If it wasn't for the further police investigation, Mr. Auger would be heading still down the river of no return. Imagine in prison, he'd be dead within a month,,,just because he's not like you or I. Not all violent people are mentally ill. Not all mentally ill people are violent. Most children are abducted by people they know. Most children abducted by nonfamily members were out of sight of their parents. No 3 year old should be unsupervised, especially in a quasi-public setting.

The State of Maine has radically cut mental health budgets over the past 10 years. There are lots of people who won't get the help they need. This man would benefit from being in a residential program. Mental health professionals can no longer afford to do their jobs. Keep building jails...we're gonna need them.

So, do I believe them ? Maybe, if they claim that while Mr. Auger was being railroaded off to prison. But now that their story flunks the smell test, I think not. Most of these parents have no business having kids. There welfare families living off the tax-payer, ignorant and highly influence to innuendo. They watch Jerry Springer and drink cheap bear in sleazy motels and boarding houses. I would not trust them with my dog 'Buster' and he's a hell raiser, but I do love the dear beast. Anyway, as a fellow member of the law abiding community I just can not sit by and watch justice distorted because of some's prejudiced fear against a group. How many lives have been ruined in American. Let's be thankful Mr. Auger was able to see the light of justice. The police dept.deserves credit.

I don't get why filing a report that says the guy tried to grab the kid twice in one day (what the parents claim the police encouraged them to report) is more likely to 'stick' than a report that says he tried t grab him on two different days (what the parents claim happened). If anything, it would seem creepier to go after the kid on two separate days.

I agree with the posters saying to stop plastering Augers picture. Let's see a picture of the parents! And I would take an adult with major mental illness living next door to me any day over some of you very judgmental people posting about committing someone for not taking their medications or acting odd. If that was the case then many people could be committed and it wouldn't necessarily be the people diagnosed with a mental illness. People have rights and one of those rights is the right to refuse medications be it for mental illness, diabetes, heart problem, substance abuse. And I can bet that all you folks saying someone should do something to help this guy were advocating for the budget cuts for people living with mental illness. Services for folks with mental illness are not getting any better out there. CUT CUT CUT isn't that what most of you regular posters say on here?

mel1,--My gut tells me that Mr. Auger will do the right thing and take his medication and stop drinking. Cause those bars up above are still very fresh in his memory. He was very lucky this happen in Maine a State who's mental illness is off the charts and better understood. And he was lucky these parents are nothing more then lying trash. And a police dept. who cared enough to further investigate these false allegations . Further money for mental illness does no good when we can't even get them to take their medication, yes he has a right not to, but society also has a right to live without fear.

A law should be created that would require every on-duty officers events be recorded; the minute an arrest is made or someone wants to file a statement the camera should start rolling so every ounce of information could be viewed by a jury if they so choose. Nothing in Mr. Auger's quoted statements in the article make him sound mentally ill, and some people with bipolar-disorder can blend in with society so well that you would be surprised to know who you know who actually has it. I am sure that the Prescott's guilt ridden minds is the only reason this story, which is more about police action than anything else, has had the light of day shed upon it. I don't know Bernard Broder from Job, but I certainly would not trust an acting member of the good-ole-boy society; get a new lawyer, son.

That's not how police work ! We are always so quick to jump all over them. If it wasn't for their continual investigation Mr. Auger would still be in jail. Police are just like the rest of us, they went on the best information they had, which turn out later to be a lie. These parents and their community associates where caught up in their web of deceit. Mr. Auger doesn't need an ambulance chase, but justice and I believe he has that already.
