Scott Biller, a registered sex offender whose move to town raised ire among residents, is scheduled to be released from the Cumberland County Jail in the next few days, but Cape police have been told Biller will not seek to return to Cape Elizabeth.

Biller, 48, was arrested Jan. 28 on a charge of failure to register with Cape police as a sex offender when he moved to town. He rented an apartment at 196 Ocean House Road. On Feb. 9, he pleaded guilty and was sentenced to 50 days in jail, less time he had served waiting for the Feb. 9 hearing.

Biller was convicted in August 1998 in Broward County, Fla., on a charge of lewd assault and sexual battery on a victim under 16. Because of that conviction, he is required by Maine law to register as a sex offender.

On Feb. 9, Biller was also ordered by Justice Thomas Warren to get his probation officer’s approval of any housing arrangement after he was released from jail.

Capt. Brent Sinclair said Tuesday he had been told that Biller would not attempt to return to town. Sinclair was not sure where Biller would move.

Before moving to Cape Elizabeth in late January, Biller lived at 366 Cottage Road in South Portland, less than half a mile from the Cape town line.

Peter Hamlin of Algonquin Road for having an uninspected motor vehicle on Trundy Road at 10:45 a.m. March 5.

Emily Caruso of Swanton Drive, Hollis, for doing 52 mph in a 35 mph zone on Spurwink Avenue at 3:40 p.m. March 5.

Complaints

On Feb. 26 I, Officer Gaudette, was patrolling the area of Lions Field when I noticed that someone had spraypainted one of the bullpens.

On Feb. 26 I, Officer Gaudette, was patrolling the area of Cape Elizabeth High School when I noticed unknown person(s) had spray painted the side of a trailer. The trailer is located in the rear of the high school and appears to be used for storage.

On March 2 I, Eric Fay, met with a resident in the Shore Acres area for a trespass complaint. It appeared someone had been inside the residence during the day but nothing appeared to be missing. Complainant advised that this has happened two other times in the past couple weeks.

On March 2 at 1645 hours I, Officer Dorval, met with a resident of the Mitchell Road area regarding a dog complaint. The complainant was bitten while walking at Fort Williams and advised that the dog belonged to a resident of South Portland. The dog’s owner was contacted and he produced a current rabies certificate. He was served a 10-day quarantine notice and South Portland Animal Control Officer Stan Brown was notified.

Fire and rescue

The Cape Elizabeth Fire Department responded to an activated fire alarm on Scott Dyer Road at 11:03 p.m. Feb. 28, a fire alarm activation on Scott Dyer Road at 7:48 p.m. March 4, a call to the Portland International Jetport at 1:36 p.m. March 5, a smoke investigation on Mitchell Road at 11:33 a.m. March 6 and a mutual aid call to South Portland at 3:31 p.m. March 6.

The Cape Elizabeth rescue squad responded to 12 calls between Feb. 28 and March 6, transporting eight patients to Maine Medical Center and three to Mercy Hospital. One call did not require patient transport.

Accidents

A vehicle driven by Danielle Holmes was involved in a collision with a vehicle driven by Michael Kelley on Cottage Road March 1.

A vehicle driven by Matthew Oakes was involved in a collision with a vehicle driven by Richard Mullen on Ocean House Road March 2.
