PORTLAND — The Maine Supreme Judicial Court has reinstated a 2009 lawsuit filed by former independent presidential candidate Ralph Nader and his 2004 Maine electors against the Democratic Party and several of its allies.
Nader’s lawsuit, which was originally filed in Washington County Superior Court, was dismissed in November 2010. But on Friday, the supreme court threw out that dismissal, ruling that the lower court erred by denying Nader and his electors an opportunity to establish their claims.
The longtime consumer advocate claimed that Democratic leaders orchestrated a nationwide effort to interfere with his campaign by filing 29 complaints in 19 states, including Maine. His suit said many of the complaints included false allegations of fraud.
The Maine supreme court’s decision sends the lawsuit back to Washington County Superior Court.
