AUGUSTA – Maine’s Human Rights Commission has issued split rulings on allegations of unlawful discrimination, one involving a Denny’s employee and the other a tenant couple.
In both cases, the commission recommended conciliation.
Commissioners voted 2-0 Monday to support a claim by Erica Kilde of Richmond that she was subjected to a hostile work environment because of her disability when she worked for Denny’s in Augusta. Commissioners voted 3-0 to conclude that Kilde’s termination in May 2010 was not retaliation for reporting disability harassment to management.
The company said Kilde was fired for violating company policy by failing to charge a regular customer for a glass of milk.
In a separate case, commissioners voted 3-0 to find reasonable grounds that landlords Leon and Cherri White of Norridgewock and property manager George Josslyn of Farmington made unlawful statements expressing a family status preference to a couple.
Leon Wyatt Smith and Kirstin Keirstead of East Wilton had a 3-year-old, and Kierstead was pregnant. The Whites, the report said, raised concerns about small children in an apartment.
