SACO – Two local residents have been charged with liquor violations in connection with a fatal car crash last spring.

The charges stem from the June 3 crash that killed 19-year-old Jacob P. Marcotte of Saco, who had been drinking and was alone in his car when it crashed at the intersection of Flag Pond and Jenkins roads, said Deputy Police Chief Jeffrey Holland.

Kathleen Ricker, 22, of Saco was charged with furnishing liquor to a minor. Michael Herlihy, 20, of Saco was charged with allowing a minor to possess or consume liquor in a place under that person’s control.

Both were summonsed Wednesday by Saco police after indictments were handed down by a York County grand jury. Ricker and Herlihy are scheduled to be arraigned Feb. 1 in York County Superior Court in Alfred.

The investigation into the crash determined that Marcotte “had consumed an excessive amount of alcohol” and his blood alcohol content was above the 0.08 percent legal limit to drive, Holland said. Under state law, it is illegal for anyone younger than 21 to have alcohol in their system.

Witnesses told police that multiple underage people, including Marcotte, were drinking at a graduation party at Herlihy’s house at 3 Brenda Circle. Ricker had purchased some of the alcohol that night at Cumberland Farms.

“We can all learn from this tragedy and teach teenagers and young adults of the responsibilities associated with alcohol use and the danger of driving under the influence,” Holland said.
