AUBURN — Prosecutors want a Lewiston man charged with killing his infant son to undergo a mental health evaluation, but a defense attorney opposes the motion.
Danny Adams has pleaded not guilty to murder and manslaughter in connection with the December death of his 14-week-old son. Prosecutors say Adams, frustrated with the baby’s crying, forced a pacifier in his mouth. The cause of death was ruled asphyxiation.
The Sun Journal reports that in a motion filed in Androscoggin County Superior Court seeking the evaluation, prosecutors say they want to know if Adams was “suffering from an abnormal condition of mind,” at the time.
The 24-year-old Adams’ attorney says the request is unconstitutional and if the state thinks Adams had “an abnormal condition of mind” at the time then charges should be dismissed.
