A fracas about a handgun and a knife led to a man fleeing in his underwear and a woman being arrested.

Kristin Hinckley, 23, of China, was charged with aggravated assault and domestic violence terrorizing with a dangerous weapon after police were called to a Deer Hill Road home late Wednesday night.

She was held without bail until Friday afternoon, when a judge at the Capital Judicial Center set bail at $500 cash with a Maine Pretrial Services supervision contract.

According to an affidavit filed in court by Deputy Toby Pond, of the Kennebec County Sheriff’s Office, Hinckley and her boyfriend, Kip Patten, 25, offered differing accounts of the incident, which followed an evening when they and their young daughter visited friends on nearby Sampson Road, in Windsor, and went home separately.

Hinckley told Pond she was asleep when Patten arrived home, woke her, punched her in the face and threatened to kill her. She said she grabbed a firearm from the nightstand and a knife and pulled the trigger, but nothing happened. According to Pond’s affidavit, “Kristin stated, ‘When I got free, (I) somehow managed to grab the gun from the nightstand.’ Kristen stated she had the gun pointed at Kip who told her, ‘If you pull the trigger you’ll kill me.'”

Patten told police he was trying to fall asleep when Hinckley arrived home with their daughter. Patten said Hinckley came at him with a gun, pulling the trigger several times and realizing it was unloaded. He said he grabbed her arm to get the gun away from her as she crawled across the bed to get the ammunition out of a nightstand.

Then when he went into the kitchen with the firearm and ammunition, he told police, he felt a sharp pain in his shoulder and turned to find her with his hunting knife.

He said that when she refused to drop it, he pushed her toward the living room, where she fell. He told Pond he fled out the door and drove to the friend’s house where he had been earlier. Patten told police that he thought Hinckley was reacting to his ex-girlfriend sending him texts.

Hinckley was taken to MaineGeneral Medical Center in Augusta for evaluation after Delta Ambulance personnel treated her for a small cut on her head.

The friend told police that the couple had been in good spirits, that Patten had left first to go home, and he was shocked to see him return in nothing but his underwear.
