CAPE ELIZABETH — A site plan review and public hearing will be held April 25 for a medical office building and apartment complex proposed at 12 Hill Way.

The Planning Board considers the minor subdivision application submitted March 15 by the owners of Cape Chiropractic and Acupuncture to be complete.

Amber and Zev Myerowitz, owners of the business at 2 Davis Point Lane, want to construct two, three-story buildings on Hill Way, with a connector between them. Each building – one nearly 3,800 square feet and the other more than 2,400 square feet – will have the medical business on the first floor and apartments above.

The project proposes 10 townhouse-style apartments, with six in one building and four in the other. The Myerowitzes said they plan to live in one unit, and they are not yet sure what the rent will be for the others.

“We do not have exact figures yet, but (they) will be in line with market rates for new construction with high-end amenities,” Amber Myerowitz said.

Myerowitz said it’s important for Cape Elizabeth residents to have various housing options and that the apartments would be ideal for “empty-nesters” and small families.

“There is a significant shortage and demand for units such as ours due to a variety of demographics,” she said. “With our units as close to the school system as possible, they are a safe and secure place that will be desired by small families.”

The Town Council in October approved an ordinance that would allow more multi-unit housing in town, but it was only applicable in residential zones.

The Myerowitzes’ project falls within the town center zone and meets the standards of the town center zoning ordinance and design standards. The project also fulfills the Town Council’s goal of improving the area around Hill Way, and the Town Center Planning Committee’s desire to have a mixed-use building in the town center.

Myerowitz said some residents living on and around Hill Way have concerns about the development, but she said the “two modest buildings” would “be right at home” in that area.

“We understand residents adjacent to a commercial lot express concern when that commercial lot is developed, but they need to understand that every inch of the development conforms to town center zoning standards and we meet or exceed all rules and regulations,” she said.

The zoning requirements allow up to 18 units to be built. Also, in compliance with the zoning ordinance, the project will have a stormwater management plan, a front setback of 25-35 feet, and a sidewalk.

All operations of Cape Chiropractic and Acupuncture would move to the Hill Way location. The company employs six people and Myerowitz said “as our practice grows we anticipate the need for future staff.”

The development would generate traffic of six to eight cars per hour, she said. The project proposes 51 parking spaces for commercial and residential parking.

The Myerowitzes bought the 2.1-acre property in 2014 for $915,000. They have subdivided it into three lots, and the project is being planned for the largest lot. One of the other lots has a farmhouse on it and the other is undeveloped.

If approved by the Planning Board, Myerowitz said the plan would be to start construction this fall and have it finished by the summer of 2017.
