M.D. Harmon’s May 27 Press Herald column stated that “11 states, including Maine (at Gov. LePage’s behest), filed suit against the administration on this issue,” referring to the Obama administration’s school bathroom access directive. That is a misstatement.

Gov. LePage joined the suit as a private individual. The state has nothing to do with the suit, and could not, since the Maine Supreme Judicial Court ruled in 2014 that schools may not discriminate against transgender students.

A staff person in the governor’s office confirmed to me May 26 that not one cent of state money was being spent in support of this lawsuit.

I am sure that Mr. Harmon will want to correct this misstatement in his next column.
