The Windham Police Department reported Monday that an ongoing investigation has led to grand jury indictments of a Standish couple, who owned and operated a Windham business.

Charges include theft by deception and negotiating worthless instruments. According to court documents, the business wrote more than $140,000 in bad checks, the largest being for $100,000, WMTW reported.

Joseph W. Mercurio, 39, and Ann M. Mercurio, 32, both of 8 Wildbrook Lane in Standish, face multiple charges, said Lt. Jim Boudreau of the Windham Police Department.

They owned and operated Toretto’s Garage at 1004 River Road in Windham from the fall of 2015 until spring of 2016, Boudreau said in the police report.

The business, Boudreau said, is now closed. The Mercurios could not be reached Tuesday by the telephone number posted on the garage’s website. A recording said the number was disconnected or no longer in service.

A Toretto’s sign once posted on the building did not appear there Tuesday morning.

The Cumberland County grand jury indictment list released on Sept. 9 shows Joseph Mercurio was indicted on nine charges including three Class B counts of theft by deception; two Class C counts of theft by deception; two Class B counts of  negotiating a worthless instrument; and two Class C counts of negotiating a worthless instrument. Police alleged the offenses occurred between Nov. 1, 2015, and May 12, 2016.

According to the grand jury list, Ann M. Mercurio was indicted on two Class C counts of negotiating a worthless instrument. Police alleged the two offenses occurred on March 14, 2016.

Boudreau’s report said Paul Cox, a Windham detective, investigated the case over several months.

“Summonses of indictment will be issued by the Unified Criminal Docket of the Portland court system,” Boudreau said. “Arraignment dates have not been determined.”

Boudreau reported Monday that no additional information would be released for now.

Now closed, Toretto’s Garage, 1004 River Road in Windham, had been owned and operated by Joseph W. Mercurio and Ann M. Mercurio of Standish. Following a Windham police investigation, they have been indicted by a grand jury.
