The second suspect in the death of a man in Biddeford last month made a brief appearance in court Thursday, but attorneys said little about his case.

Garret Labonte, 45, was arrested Monday and charged with murder, felony murder and robbery in connection with the death of 46-year-old Gene Dares, who was shot on Foss Street in late September.

Labonte appeared in York County Superior Court Thursday morning via Zoom. He did not have to enter a plea. He has yet to be indicted by a grand jury and will be held without bail. His attorneys could argue for bail at a future hearing.

A few of Dares’ family members tuned in for the brief hearing but did not speak.

Dares grew up in Biddeford, according to an obituary. He was a son, brother and father to three girls.

Labonte is one of two people facing charges for Dares’ death. Linda Lambert, 56, faces felony murder and robbery charges.

During her first appearance Wednesday, a prosecutor suggested Lambert set up a fake drug deal so Labonte could kill Dares. Her attorney pushed against that claim, suggesting Lambert could have just been a witness to the crime, which lawyers say occurred in front of her home.

Few details of the allegations against Labonte were shared in court Thursday. Court records in both cases are still sealed from the public.

Labonte’s attorneys, Luke Rioux and Mark Peltier, and Assistant Attorney General Jennifer Ackerman spent around 20 minutes with Superior Justice Richard Mulhern in a Zoom breakout room before the hearing began, during which Mulhern asked Labonte if he had time to speak with his lawyers and if he understood his rights.
