PORTLAND — The U.S. Equal Employment Opportunity Commission has filed a lawsuit against Kohl’s Department Stores for refusing to accommodate a diabetic employee’s schedule request at its store in Westbrook.

The EEOC filed the lawsuit today in federal court in Portland.

The suit claims Kohl’s violated the Americans With Disabilities Act by refusing to accommodate Pamela Manning’s requests for a set schedule to prevent complications from her diabetes. The agency says Kohl’s ignored the requests while accommodating other employees’ schedule requests for reasons such as day care and transportation needs.

The EEOC says it unsuccessfully attempted to reach a settlement with Kohl’s before filing the complaint.

A call to a Kohl’s spokeswoman was not immediately returned. Kohl’s is based in Wisconsin and operates more than 1,000 stores in 49 states.
