The Planning Board will discuss a contract zoning application and site plan application on Tuesday proposing to develop property at 137 Leeman Highway.
The discussion will take place during the board’s 6 p.m. meeting on Tuesday at City Hall.
According to a memo from City Planner Andrew Deci to the board, Mark Sewall seeks approvals to “develop the eastern half of the block formed by Chandler Drive, Court Street, Quimby Street and Leeman Highway/ Route 1.”
Deci writes that neither Sewall nor city staff seek any action from the board on Tuesday as there are “many outstanding issues, including title to the property, which must be addressed before the Planning Board can take action.”
The board will need to find that the site plan is complete, and that the applicant has demonstrated that the applicable general performance standards for site plans will be met, according to Deci, for site plan approval. Tuesday’s meeting will allow the Planning Board to provide Sewall feedback on the application.
Back before the board will be PMH Real Estate, the developer of the previously approved Plant Home expansion project. PMH Real Estate seeks a oneyear extension of the site plan validity, which expired Dec. 25, 2014. The request was made prior to the expiration of the site plan, Deci’s memo notes.
The board will also consider a proposed amendment to the city’s wireless communications ordinance. Mariner Tower LLC has submitted an application to amend Article 17 of the land use code, according to Deci’s memo.
The proposed draft ordinance as revised clarifies a “ fall zone requirement” within the ordinance. Deci writes that staff agrees the current land use code text is unclear as to the nature of the requirement as “a space and bulk standard or a performance standard.”
The board must find that the amendment “is appropriate and meets the intent of the comprehensive plan,” said Deci, to approve it.
David Hudson has requested site plan approval for relocation of a non-conforming structure in the shoreland zone at 129 Varney Mill Road; and the replacement of a structure in the shoreland zone. Hudson seeks to replace an existing trailer on the property and to remove an existing shed from the property to reduce the nonconformity and add square footage to the existing trailer. He seeks to replace that trailer with a trailer of equal total square footage.
The Planning Board will also consider a site plan amendment requested by the United Church of Christ to “facilitate a pending land transaction” at 150 Congress Ave. The church is selling a portion of property and the subdivision of the land requires amending the existing site plan. By either removing a parking area or relocating the proposed line, the site meets the standards of the code, Deci writes.
