With regard to your article about the Scarborough Town Council and the Conservation Commission (“Council curtail’s group’s duties,” July 24 Current), your article incorrectly implies that (the Conservation Commission’s) Board of Environmental Protection petition was dismissed for some lack of merit.

Though the Board of Environmental Protection dismissed our petition, they did so with our agreement after the issues we raised were being corrected by the developer and we stated that because the issues had been resolved we did not need or choose to go to the public hearing stage of the petition process.

If we had not filed the petition, the Maine Department of Environmental Protection would not have required the many changes nor would they have discovered that the retention pond needed a complete redesign. This is an important distinction.
