A 22-year-old Bath man was allegedly driving 135 miles per hour on Route 1 while under the influence of alcohol the night of March 19, when he rear-ended another vehicle, sending three people to local hospitals, according to an indictment handed down Tuesday by a Sagadahoc County grand jury.

Joseph T. Boyington, 22, whose address is listed as 58 Winship St., Bath, was indicted on nine counts, including Class A felony elevated aggravated assault and two Class B felony counts of aggravated assault as a result of the incident.

The dramatic two-vehicle crash closed Route 1 for several hours the evening of March 19 while a LifeFlight helicopter and emergency medical crews responded to the scene, in the northbound lane of Route 1 just north of the Congress Avenue overpass.

Boyington’s passenger, 21-year-old Michael Mason of Brunswick, was taken by LifeFlight to Central Maine Medical Center with “serious, lifethreatening injuries,” police said at the time. According to the indictment, Mason suffered “serious bodily injury.”

Police said in April that Boyington was under the influence of alcohol when his 2003 Acura crashed into the back of a 2008 Lincoln sport utility vehicle. That vehicle’s occupants, a 43-year-old woman and her 11-year-old son, required ambulance transport to Mid Coast Hospital in Brunswick. Both were treated and released. Boyington was treated at Maine Medical Center following the crash.

According to the indictment, Boyington was allegedly traveling at a speed of 135 miles per hour at the time of the crash, exceeding the posted speed limit by 100 miles per hour.

Investigators from the Maine State Police and the Brunswick Police Department reconstructed the crash, according to Bath Police Chief Mike Field.

Boyington also was indicted on Class C counts of aggravated criminal operating under the influence, driving to endanger, and three counts of reckless conduct.
