Planning Board members tonight will decide whether to once again approve a final site plan for the 19-lot, fourphase Brunswick Commerce Park.

William Moore, president of Moore Properties Inc., first submitted plans in 2008 for the 94-acre project tucked between U.S. Route 1 and Durham Road.

It was approved in June 2009 and an amended plan approved four months later. However, the final site plan approval never was recorded in the Cumberland County Registry of Deeds, which is required by state law within 60 days of the Planning Board’s decision.

Town officials discovered the error while doing title and deed research for one of the potential new owners.

The original site plan included four residential lots, 14 commercial-industrial parcels and a 31-acre piece that would remain in its current natural state under Moore’s ownership. A 2,230-foot-long paved access road loops through the development, but currently is barricaded to keep motorists out.

Three of the residential lots already have been sold and one house built, with an occupancy certificate awarded. A fourth house lot is under contract, but the sale can’t be closed until the bookkeeping mess is cleaned up, said Town Planning Director Anna Breinich.

Breinich said she didn’t know why the deeds were never recorded.

Neither does the town’s engineer.

“It’s the developer’s responsibility to record the deeds,” Breinich said.

Also tonight, board members will hold a workshop with Cara and Cecile Stadler, the owners of Tao Restaurant on Pleasant Street, regarding a possible expansion.

The Stadlers also would like to build an aquaponic greenhouse and underground parking facility adjacent to the existing structure

The meeting is scheduled for 7 p.m. in Town Council Chambers at Brunswick Station.
