SCARBOROUGH – With representatives of Hannaford Bros. still objecting, last week the Scarborough Planning Board gave final approval to Phase II of the Town & Country Federal Credit Union project off Little Dolphin Drive.

One of the issues, according to Tyler Sterling, who appeared at the July 14 meeting on behalf of Hannaford, is that according to the grocery store company, the development would negatively impact the level of service at the intersection of Hannaford Drive and Route 1.

In addition, Sterling said that Risbara Bros. has no right of access to Foley Farm Road, although the development calls for providing access from the credit union site to the disputed road.

After a lengthy discussion, the Planning Board determined that the issue of access to Foley Farm Road by Risbara Bros. is a private, civil matter that has no bearing on the town or its ability to approve the second phase of the credit union project.

After the meeting, Jay Chace, senior town planner, said the Planning Board determined that Risbara had the “proper right, title and interest” in the 2-acre lot he is developing on Little Dolphin Drive and that was enough to give final approval to the entire development proposal.

According to Nancy St. Clair, of St. Clair Associates, who was representing Risbara Bros. at last week’s meeting, full build-out of phases I and II of the credit union project would result in construction of a 40,000 square-foot office building that would be connected by an atrium.

She said Phase I, which was approved last December, is well under way, including a new parking lot, a stormwater system and the extension of Little Dolphin Drive to Foley Farm Road. St. Clair also said a sidewalk is now under construction, which would connect the credit union’s new headquarters to Hannaford Drive.

During the course of the meeting, Sterling asked the Planning Board to deny the application for Phase II of the project or require Risbara Bros. to limit access to the site solely from Little Dolphin Drive.

He also requested that the town require Risbara Bros. to pay some sort of mitigation fee due to the adverse traffic impacts Hannaford is expecting from the project.

While Allen Paul, chairman of the Planning Board, initially suggested that the board put off discussion of the Town & Country project, the board eventually ended up taking action, with one of the members vehemently objecting to put off voting, saying that Hannaford was indulging in “delaying tactics.”

And Chace reminded the board that the town attorney had previously indicated that the dispute regarding access to Foley Farm Road was “outside the purview” of the town.
