The Planning Board will consider a land use map change, contract rezoning and site plan approval for a new proposed CVS Pharmacy at the corner of Court and Floral streets.

The board meets tonight at 6 p.m. at City Hall.

The new CVS Pharmacy would be located on a 1.8- acre site comprised of four parcels. They include 131 Court St., where a 1,657- square-foot seafood restaurant — Gilmore’s Seafood — is located. Vacant land with an asphalt parking area is located on the 127 Court St. parcel. The lots at 82 and 86 Floral St. contain a single family residential dwelling and a three-unit mixed residential and commercial building, respectively.

The applicant — TMC New England LLC — plans to remove the existing structures and replace them with an approximately 13,225- square-foot CVS Pharmacy with a drive-through window. CVS Pharmacy currently has a store in the Bath Shopping Center near the new proposed site.

A land use code map amendment is requested. Bath City Planner Andrew Decci said the property now falls in the R1 and C2 zones, but the applicant is proposing a high traffic retail business with a drive through that requires it be in the Highway Commercial Zoning (C4) District.

Deci said in order to construct the CVS building as proposed on this site, due to resulting setback infringements, a contract zone is needed. In order for the city to grant flexibility with zoning requirements through contract rezoning, it seeks public benefits from the applicant in exchange. Deci said Monday he expects to have an updated list of proposed public benefits presented tonight.

TMC New England LLC also seeks site plan approval for the new CVS Pharmacy, which the planning board will consider. Deci said it is possible the architectural design could be an issue board members discuss tonight.

The Planning Board also had a site plan application for filling, submitted by Bathres LLC for 140 Richardson St. Deci said Bathres LLC owns the parking lot across the street from the new hotel currently under construction where the former Bath Holiday Inn once stood. It also has purchased three homes on the corner of State Road and Richardson Street and proposes to use blasted material to fill the lots and turn them into a development site.

After receiving approvals from the city earlier this spring to construct a Residence Inn Marriott hotel at 139 Richardson St., Bathres LLC requested to meet in a pre-application workshop with the Planning Board tonight before submitting a site plan amendment.

Deci said the hotel chain, Marriott, did not sign off on the final building design and wants to change the look and elevation of the building. The applicant seeks feedback from the Planning Board before submitting a site plan amendment application.

Plans called for a new 103- room hotel, the first phase to include construction of 87 rooms. A contract rezoning the city council approved for the project, containing a greater maximum height limit than allowed in the C4 zone otherwise, would not require amending, Deci said.
