BIDDEFORD — Three men have been indicted on charges of intentional or knowing murder and conspiracy to murder in relation to the 2013 shooting death of a Biddeford man.
A York County grand jury indicted Bub Peter Nguany, 27, of East Grand Avenue, Old Orchard Beach, on the charges along with John Lopez, 20, of Pinebrook Terrace, Old Orchard Beach, and Mohamud Mohamed, 21, whose last known address was in Portland.
Nguany was arrested on March 26, 2013, just hours after Charles Raybine was found shot to death in a rental car in the parking lot of Parish Place Apartments, at 41 Birch St.
According to court documents, Raybine, 47, was with his nephew Morgan “Mo” Palmer on the night of his death, and Palmer’s description of the shooter led Old Orchard Beach police to Nguany.
Officer Scott Jarrett arrested Nguany at about 9 a.m., as he was attempting to leave his residence in a taxi cab, the documents state. A search of his backpack later yielded a .45-caliber handgun and ammunition matching the shell casings recovered from the scene of the shooting.
Nguany was charged with murder in Raybine’s death in June of that year. His trial was initially scheduled for May but has since been pushed back to a later date.
On April 28, Lopez was arrested and also charged with murder in Raybine’s death, and just a day later, state police announced they had issued a warrant charging Mohamed with murder in the shooting.
Officials have declined to comment on why it took more than two years to charge Lopez and Mohamed with the crime.
In an email Thursday, Stephen McCausland, a spokesman for the Maine State Police, said authorities are still searching for Mohamed. The best information they have suggests he is still in the Portland area, he said.
It is too early to say whether the men will stand trial jointly, Timothy Feeley, a spokesman for the Maine Attorney General’s Office, explained in an email Thursday.
An indictment is not a finding of guilt but a ruling that enough evidence exists to commence prosecution. If convicted, each man faces 25 years to life in prison.
