AUGUSTA (AP) — The widower of a former Maine police officer who was killed in a motorcycle accident in Augusta after hitting a pothole has filed a wrongful death lawsuit.
The Portland Press Herald reports Jared Nightingale is suing R.J. Grondin & Sons, the city of Augusta, the state and the Maine Department of Transportation for unspecified damages.
Karen Nightingale was 53 when she died July 15, 2014. The accident occurred nine days earlier at 4:30 p.m. on Western Avenue, where there was ongoing road construction.
The suit states Karen Nightingale hit a pothole measured at “28 inches long, 16 inches wide, and 5-8 inches deep” and was thrown from her motorcycle.
Jared Nightingale says liability for inspection and safety is shared by Augusta, the state, the Department of Transportation and Grondin.
