AUGUSTA (AP) — A hearing may be delayed about a prosecutor’s request that a defendant charged with killing his father be treated with medication without his consent.
Leroy Smith has been found incompetent to stand trial and the state says the medication could change that. He is charged with killing his father in the apartment they shared in Gardiner in May 2014.
Assistant Attorney General Deborah Cashman says a Sept. 22 court date about the request could be delayed because the defense is asking for a continuance. The court date concerns the setting of a date of a hearing, which is necessary for the application of involuntary treatment to go forward.
