The administrator of Two Bridges Regional Jail arrested last year for operating under the influence has been granted a deferred disposition.
Mark Westrum was arrested Oct. 7, 2016 by Bath Police for OUI and, according to court documents, had a blood alcohol content of 0.15 or more.
Wednesday, he met with a judge and was granted a deferred disposition, with supervision to occur in Androscoggin County. Based on the agreement, Westrum’s plea of guilty is accepted and sentencing is deferred for six months to July 5.
According to state statute, following the acceptance of a plea of guilty for a crime for which a person is eligible for a deferred disposition, the court may order sentencing deferred to a date certain. The court can impose requirements upon the person during the period of deferment, “considered by the court to be reasonable and appropriate to assist the person to lead a law-abiding life.”
Under the agreement, Westrum enters a plea of guilty and must appear in court as notified and refrain from all criminal conduct and violation of state and local laws.
He must undergo a substance abuse evaluation counseling. He can’t be present at establishments that primarily serve alcohol, and must continue regularly attending AA meetings. He is also subject to having his residence or vehicle searched and undergoing chemical testing upon the request of a law enforcement officer.
Among the requirements, Westrum also must comply with conditions of any bail order, and pay an administrative supervision fee to the district attorney’s office at the rate of $25 per month.
If there are no violations of bail on the deferred disposition agreement, the state will dismiss the first count of OUI and allow Westrum to plead guilty to a second count of OUI with no aggravating factors for the mandatory minimum $500 fine, and a 150-day loss of his license.
If he violates any of the requirements, he could be arrested and detained, could land additional requirements or be terminated from deferred disposition and sentenced immediately.
Westrum has been on paid administrative leave from the jail since Oct. 12. Last month, the Lincoln and Sagadahoc Multi-county Jail Authority voted to pay Captain James Bailey at the administrator’s rate of $40.98 an hour, retroactive to Oct. 26 when Bailey took over the duties of correctional administrator for the jail.
