Gorham has filed a response to a citizens’ lawsuit seeking reversal of the town’s approval of a quarry.

The defense of the town’s action was “just mailed yesterday to Superior Court,” Gorham’s attorney, William Dale, said Wednesday.

At issue is the Planning Board’s approval in March of a request by Shaw Brothers Construction Inc. for a quarry at an industrially zoned site on Mosher Road. In April, the Planning Board approved an asphalt plant at the site for the construction company. A group that opposed the project, Concerned Citizens of Gorham, and four individuals appealed the quarry decision to Cumberland County Superior Court on April 30. The town, Planning Board and Shaw Brothers Construction Inc. were named as defendants. The town was given 20 days to respond.

The Gorham Town Council met with Dale in executive session in a special meeting at 4 p.m. Tuesday to discuss recent litigation, according to the published agenda.

In a phone call following the meeting, Burleigh Loveitt, chairman of the town council, declined to comment about any details of the meeting. “I’m not discussing anything said in the meeting,” Loveitt said.

But, when asked about the Concerned Citizens of Gorham appeal, Loveitt said, “We intend to defend the town’s interest and volunteers of the Planning Board and the careful, diligent work they did.”

Shaw Brothers Construction Inc. introduced the quarry and asphalt plant project in 2006, and it went through a lengthy review.
