After overcoming several hurdles posed by the city and the state – the latest on Wednesday night – the Skybox Bar and Grill will be able to reopen on Brown Street.

The Zoning Board voted 4-1 to overturn Code Enforcement Officer Rick Gouzie’s ruling that the bar didn’t meet the requirements of the zone.

Gouzie had determined that without a kitchen, the establishment would be considered a Class 3 restaurant, rather than a Class 2 restaurant. The kitchen was separated from the bar per request of the Department of Public Safety’s Liquor Licensing and Compliance Division, which wouldn’t grant a liquor license to owner Allen Moore while he was sharing a kitchen with The Good Chef catering company, in the same building

However, it was those renovations that led to Gouzie’s decision.

Neither Class 2 nor Class 3 restaurants are permitted in the zone the building is in; however, the property was a Class 2 restaurant before the current zoning was established, so that use was grandfathered.

“It seemed clear to us that the use had not changed” from the bar that existed there before, said Phil Brown, chairman of the Zoning Board.

Spending Thursday cleaning up the bar, Moore said he was “wicked excited” about the decision.
