A lieutenant in the Westbrook Fire Department who was demoted after an investigation into charges of sexual harassment had his position restored by the state’s Board of Arbitration and Conciliation.

Donald Trafford was among seven members of the Westbrook Fire Department who were punished for what the city deemed to be inappropriate actions and language in the workplace or failure to properly deal with complaints that contributed to a hostile work environment. The disciplinary actions came after two female firefighters, Kathy Rogers and Lisa Theberge, complained about the hostile environment in the department.

Trafford, who was demoted from lieutenant to firefighter and suspended for one week, received the harshest punishment. The punishments for the other six firefighters who were disciplined ranged from a letter of reprimand to a 60-day suspension. Trafford was the only firefighter to file a grievance with the state’s Labor Relations Board.

After a hearing, which concluded last month, the Board of Arbitration and Conciliation ruled Friday that the city’s demotion of Trafford was “a penalty that exceeds the situation,” according to a written decision from the three-member panel.

The board reinstated Trafford as a lieutenant in the department and extended his suspension to two weeks.
