The Maine State Attorney General’s office has reached a settlement with Pike Industries, headquartered in Belmont, N.H., after the state alleged Pike Industries had violated antitrust laws.
Pike Industries has entered into a consent agreement, while maintaining that it did not violate antitrust laws in its 2005 acquisition of its competitor, Blue Rock Industries, based in Westbrook. Blue Rock Industries stayed in business selling stone,but sold its Westbrook quarry and asphalt production capabilities to Pike Industries.
The consent agreement, which still must be approved by the courts, requires Pike Industries pay $20,000 to the attorney general’s office for costs in the case, sell stone from its quarry in Westbrook at inflation-adjusted 2006 prices to firms working on certain road projects, allow firms working for certain state projects to locate a portable asphalt mixing plant at the Westbrook quarry, and provide written notice to the state 60 days prior to any further planned acquisitions of competitors.
Pike Industries has also been confronted by accusations of violating antitrust laws in the 1980s, when its then-president served 30 days in jail on charges related to a federal antitrust investigation.
