The Occupational Safety and Health Administration has contacted the Topless Roofing and Siding Company of Gorham about an alleged incident in which a man fell from a roof one month ago in Portland.

Stacy Bulgajewski, president of Topless Roofing and Siding Company, confirmed Tuesday that OSHA had contacted her about the incident. Bulgajewski answered a telephone call from the American Journal while working on a roof Tuesday.

“The guy is totally fine,” she said.

But Bulgajewski then declined further comment. She referred other questions to her lawyer, Joel Vincent. “I’m not at liberty to discuss the matter at this time,” Vincent said.

OSHA offered little information about the incident. According to Portland Police, a 37-year old Lewiston man fell from a roof while shingling on the morning of Nov. 21. Lt. Vern Malloch of the Portland Police Department said the roofer fell from the two-story building at 559 Brighton Ave. The man was taken to Maine Medical Center, but information about his condition was unavailable.

Malloch said the man, who he identified as a roofing contractor, was stripping shingles. Police said the man landed between the Brighton Avenue building, which houses a bakery, and the Cumberland Farms store next door. He said Portland Police notified the Occupational Safety and Health Administration about the incident.

Karen Billups, assistant area director of OSHA, said Tuesday it “issued a report” on Dec. 12 to Topless Roofing and Siding and she said the company received it on Dec. 13. Billups said OSHA inspected the scene of the alleged incident and is continuing the investigation. She said an OSHA investigator was sent to the scene. The man fell about 25 feet, she said. But Billups declined to name the man who fell.

According to Billups, Topless Roofing and Siding Company has 15 days to respond to the OSHA report /////, which apparently includes pending citations. Billups said violations are only alleged.////

OSHA refused to release the report or further information until the case is closed. Billups said that once the case is closed the information could be requested in a letter under the Freedom of Information Act.

A Portland MEDCU official referred a telephone call last month about the incident to Portland Police.
