Patrick Dapolito appeared in York County Superior Court in Alfred this afternoon, after being charged with shooting his wife in the head  and dumping her body at his father’s house in western Maine.

According to a police affidavit, Dapolito said the shooting was an accident, that he had used about a quarter-ounce of cocaine and was lying on the bathroom floor with Kelly Winslow when the 9 mm pistol he was holding went off.

Dapolito told police he panicked and hid the body in his basement freezer. He said he later persuaded his brother to lend him a pickup truck which he used to take the body to Upton where his father has a house.

Dapolito told police he hid Winslow’s body under a tarp at his father’s house, then returned the truck to his brother’s house in New Sharon, where he burned the bloody clothes from the shooting.

When her body was found, Winslow had a handcuff attached to one wrist. Dapolito has a previous arrest for domestic violence with another partner and police believe he threatened and abused Winslow prior to the killing.

The judge ordered that Dapolito be held without bail pending a hearing to be scheduled later.

ALFRED — A lawyer for a 39-year-old Maine man charged with murder in the fatal shooting of his wife says the shooting was an accident.

David Van Dyke told WMTW-TV that Patrick Dapolito told him that a gun accidentally discharged and the bullet struck his wife, 30-year-old Kelly Winslow-Dapolito, in the head on March 16 at their home in Limington.

Dapolito reported his wife missing two days later and was charged with murder on Saturday. He is making his first court appearance today in York County Superior Court in Alfred.

Van Dyke said Dapolito told him he led detectives to his wife’s body in Upton and waited so long to contact police because he was so shocked after witnessing his wife’s death.

12:11 p.m.

A Limington man charged with killing his wife then dumping her body in remote western Maine is scheduled to make his initial appearance this afternoon in York County Superior Court in Alfred.

Patrick Dapolito is charged with killing Kelly Winslow who died of a gunshot wound to the head. Police say she was killed at the couple’s home in Limington on March 16.

Dapolito reported her missing two days later and her body was found March 19 of Route 26 in Upton where Dapolito’s family has a home.

At his initial hearing, Dapolito can ask to be released on bail but the state also can move to have him held without bail pending a special hearing to keep him locked up until trial.
