FAIRFAX, Va. — The drunken driving arrest that forced the head of the Federal Aviation Administration to resign last year is headed to trial.

A judge in Fairfax, Va., is scheduled to hear the case against 65-year-old Randy Babbitt Thursday morning.

Babbitt was arrested Dec. 4 after a patrol officer said he spotted Babbitt driving on the wrong side of the road.

Babbitt resigned shortly after his arrest became public.

A first-time DWI offense in Virginia is considered a misdemeanor, and is punishable by up to a year in jail.
