AUGUSTA — State law requires that there be at least 100 miles between casinos and other slot-machine facilities in Maine.

Does that mean 100 miles as the crow flies or 100 miles that a car would travel between the two sites? The law doesn’t say.

The question is critical because a developer has chosen a site that is 96 miles from Hollywood Slots in Bangor, when measured in a straight line, and 125 miles when measured by a car’s odometer.

The Gambling Control Board today wrestled with the question as it prepared to review an anticipated application to build a casino in Oxford.

Although the board did not give a conclusive answer, members said they are open to the argument that voters last November presumed it would be “road miles” because there would be no other way to build a casino in Oxford County.

Officials at Black Bear Entertainment appeared pleased by the outcome of the meeting. They said they are now confident enough to move forward and submit an application, a process that would cost a half-million dollars.
