BANGOR – The defendants in a wrongful death lawsuit filed by the father of a Bangor man who died several days after police subdued him with a stun gun have asked a judge to dismiss the suit.

WABI-TV reported that at a hearing Tuesday, a lawyer for the city of Bangor, the police department and several officers asked the judge to issue a summary judgment in the defendants’ favor.

The suit alleges authorities used excessive force and failed to get proper medical treatment during the September 2012 arrest of 28-year-old Phillip McCue. Police used a Taser on McCue while he was high on the drug bath salts. He died at a hospital days later.

The state attorney general determined that use of the Taser was justified.

The judge did not rule.
