It is interesting to hear conservatives say that it is discrimination for President Biden to say that he is going to appoint a Black woman to the Supreme Court.

And yet, until 1967 in the U.S., the unspoken sentence related to Supreme Court nominations was “As president, I will be appointing a white man to the Supreme Court.” And up until 1981, that sentence still read “As president, I will be appointing a man to the Supreme Court.”

The only difference: These assumptions were so well understood in terms of power and culture, they didn’t even need to be said out loud.
