Contest Official Rules

CONTEST: Portland Press Herald/Maine Sunday Telegram Find Crusher Contest (the Contest) begins at 12:00 a.m. EST on Nov. 15, 2013 and ends at 11:59 p.m. EST, March 31, 2013 (the Entry Period). Each person who submits an entry shall be referred to herein as an Entrant.
 

CONTEST SPONSOR: MAINETODAY MEDIA, INC., a Delaware corporation having a mailing address of One City Center, Fifth Floor, Portland, Maine 04101 (the Sponsor).
 

ELIGIBILITY: Employees, temporary employees, independent contractors, officers, directors, representatives and interns of Sponsor, its affiliates and subsidiaries and the immediate family members of and any persons living with, any such employees are not eligible to enter or to win. The term immediate family members includes spouses, parents, grandparents, siblings, children, and grandchildren. Persons employed by or affiliated with any of the judges selected by the Sponsor shall also be ineligible to enter.


ENTRY:
Entry forms are available online at pressherald.com/findcrusher. Entries must be received by 11:59 p.m. EST of the day that the contest runs.  Entries should include name, phone number, email, what page of the paper the Crusher icon was found on, and a photo.

Winners will be required to pick up tickets at One City Center, Portland, ME 04101 during regular business hours, unless other mutually agreed upon plans for exchange are made with Rachel Hester-Huynh, Consumer Marketing Manager, One City Center, 2nd Floor, Portland, ME 04101. 

Entrants agree to allow their entries to be published in any form by the Sponsor. The information you submit in connection with entering the Contest may be added to one or more mailing lists maintained by the Sponsor.  

The Sponsor is not responsible for lost, late, postage-due, misdirected or delayed entries or entries not received for any other reason, or for errors in these Official Rules. Sponsor reserves the right to correct any and all printing, typographical, or mechanical errors.


Right to Use Images without Compensation:
Each Entrant, by entering the Contest, agrees that any photographic images of the Entrant taken in connection with the Contest, may be freely used, without compensation, by the Sponsor and its affiliates and subsidiaries for publicity, marketing, advertising, news reporting, publication, and other commercial purposes.  Each Entrant, by entering the Contest, agrees that Sponsor shall have sole and exclusive ownership of photographic images of the Entrant taken or submitted in connection with the Contest, and that Sponsor and its affiliates and subsidiaries shall have an unlimited, perpetual, non-exclusive license to use, publish, reproduce, distribute, transmit, display, exhibit, exploit, project, advertise, and promote any image submitted by such Entrant, all without any compensation to the Entrant.  By submitting or providing any images to the Sponsor, the Entrant represents and warrants that he/she has a right to use such images and the images are not copy regulated.


Representation and Warranty Regarding Originality of Photos:
Each Entrant, by submitting a photo, represents and warrants to the Sponsor and its affiliates and subsidiaries that the photo submitted by the Entrant is an original photo created by the Entrant, and is not subject to claims of ownership, copy rights, or exclusive licensure by any other person.  The Entrant agrees to indemnify, defend, and hold the Sponsor and its affiliates and subsidiaries, and their respective officers, directors, employees, representatives, licensees and agents (the Indemnified Persons) from and against all claims, liabilities, allegations, suits, actions, investigations, judgments, demands or other proceedings brought against the Indemnified Persons, including for reasonable legal fees and expenses, arising out of or related in any way to conduct by the Entrant in breach of the representation and warranty set forth in this Section.  


PRIZE(S):
The winners shall receive 4 courtside tickets to the specified Red Claws home game. 


WINNER SELECTION:
One winner will be selected at One City Center, Portland, Maine 04101, at random by Portland Press Herald/Maine Sunday Telegram marketing staff, who will read the entries and choose finalists based on first, the correct page on which Crusher was hidden for that day and the completeness of the form, including name, phone number, email, and photo. Decisions of Sponsors shall be final and binding in all respects. Finalists will be notified by phone and/or email the first business day after the valid entry was submitted. If a finalist is unreachable after one (1) business day or is ineligible, an alternate will be selected. 

Untimely or incomplete submissions may be rejected by the Sponsor in its sole discretion. 

No transfer, substitution or cash will be awarded in lieu of stated prizes except in Sponsors sole discretion. Sponsor may replace prizes in the event stated prizes are unavailable. Prizes are non-transferable and non-endorsable.


PARTICIPATION:
By entering, Entrants agree to be bound by the decisions of the Sponsor and these Contest Rules and to comply with all federal, state, provincial and local laws and regulations. By entering, each winner accepts all of the conditions, restrictions, requirements, and/or regulations required by the Sponsor, and also agrees to accept delivery of any prizes awarded by the Sponsor.

Sponsor and its employees shall have no liability or responsibility for the prizes once they have been awarded to the winning entrants. Additionally, they will be held harmless from and against any and all losses, damages, rights, claims and actions of any kind arising in connection with the Contest or resulting from acceptance, possession, or use or misuse of any prize awarded in connection with the Contest.


LIST OF WINNERS AND COPY OF OFFICIAL RULES:
Official Rules and the names of the winner may be obtained by sending a self-addressed, stamped #10 envelope to: MaineToday, Media Inc. One City Center, Portland ME 04101. Indicate Portland Press Herald Find Crusher Contest Rules Request" or "Portland Press Herald Find Crusher Contest Winners List" on the outside of the envelope as applicable. Limit one (1) request per envelope. The request must include the name of the Contest. Winners List will be available 5 days after the winners are confirmed. INTELLECTUAL PROPERTY:
The names, logos, and icons identifying the products and services of Contest Providers are proprietary marks of pressherald.com. Copying or unauthorized use of any copyrighted material or trademarks without the express written consent of its owner is strictly prohibited.


GENERAL CONDITIONS:
All applicable local, state, and federal taxes, if any, and any and all expenses not specified herein, are the responsibility of each winner. This Contest is subject to all federal, state, and local laws and regulations and is void where prohibited by law.


RIGHT TO MODIFY CONTEST:
If the Contest is not capable of running as planned for any reason, including legal restrictions, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, the Sponsor reserves the right in its sole discretion to cancel or revise all or any portions of the Contest, or to discontinue the Contest at any time.


RELEASE OF LIABILITY:
 Entrants agree to release and hold harmless the Sponsor, its affiliates and subsidiaries, and each of their respective directors, officers, employees, agents, successors, and assigns, from any damage, injury, death, loss, or other liability that may arise from Entrants participation in the Contest or the awarding, acceptance, use, or misuse of any prize. All entrants agree that United States law shall apply exclusively to the Contest and that any dispute with respect to the Contest shall be resolved in either the federal or state courts of the State of Maine.
