CARTHAGE — A man who police say had a history of lying in the road was killed this morning after he was hit by a pickup on Route 142 in the Franklin County town of Carthage.
State police say Bert Knox, 44, was intoxicated and lying in the roadway at 5 a.m. when he was run over and killed instantly.
Kim Micks, 38, of Peru, was driving a 2005 Chevrolet pickup. He told police he could not avoid what appeared to be a dead animal in the road, police said.
No charges will be brought against Micks, who was not injured.
